“Activists Are MILITANT And Shrill” | Supreme Court Rules On Definition Of Woman
The Supreme Court has ruled that, under UK law, the definition of a woman is based on biological sex. This could affect who can access single-sex spaces and services.
The case came after the Scottish government counted transgender women in gender quotas for public boards. The group For Women Scotland challenged this, arguing that such protections should only apply to people born female.
The court decided that the Equality Act 2010 defines sex as binary and based on biology. Changing gender legally does not change a person’s sex for the purpose of these specific protections.
However, the Act still protects transgender people from discrimination. The judges said their role was only to clarify the law, not weigh in on the broader public debate.
